Welcome to SmartPeds. By accessing or using SmartPeds.com (the “Service”), you agree to be bound by these Terms of Service (“Terms”). Please read them carefully. If you do not agree, do not use the Service.

1. About SmartPeds

SmartPeds is an online educational platform providing medical board exam practice questions for medical students and healthcare professionals. All content is intended for educational and practice purposes only and does not constitute medical advice, diagnosis, or treatment.

2. Eligibility

• You must be at least 18 years old to use SmartPeds.
• By using the Service, you represent that you are 18 or older and have the legal capacity to enter into a binding agreement.
• SmartPeds is intended for medical students, residents, and licensed medical professionals.

3. Account Registration

• You must register for an account to access exam content.
• You are responsible for maintaining the confidentiality of your login credentials.
• You may not share your account with any other person.
• You must provide accurate and complete information during registration and keep it up to date.
• You are responsible for all activity that occurs under your account.

4. Subscriptions and Payments

• Access to SmartPeds content requires a paid subscription.
• Subscriptions automatically renew at the end of each billing period unless cancelled before the renewal date.
• You may cancel your subscription at any time through your account settings. Cancellation takes effect at the end of the current billing period.
• Prices may be updated with reasonable advance notice to registered users.
• Refund Policy: Refunds are available within 7 days of purchase, provided you have not accessed more than 10 questions. After that period or after significant content access, no refunds will be issued.
• Payment processing is handled by a third-party provider. We do not store your payment card details.

5. Acceptable Use

You agree not to:

• Share your account credentials with any third party
• Copy, reproduce, distribute, publish, or sell any exam questions, explanations, or other content from SmartPeds
• Use automated tools (bots, scrapers, scripts) to access or collect content
• Attempt to reverse-engineer, hack, or interfere with the platform
• Use the Service for any unlawful purpose
• Circumvent any copy-protection, access control, or anti-cheating mechanisms

Violation of these rules may result in immediate account suspension or termination without refund.

6. Intellectual Property

All content on SmartPeds — including but not limited to exam questions, answer explanations, images, graphics, and software — is the exclusive property of SmartPeds or its licensors and is protected by copyright and intellectual property laws. Your subscription grants you a limited, personal, non-transferable, non-exclusive license to access and use the content for your own educational purposes only.

7. Medical Disclaimer

SmartPeds is an educational tool and is not a substitute for professional medical training, clinical judgment, or official licensing examinations. Content on this platform may not reflect the most current clinical guidelines. SmartPeds makes no representations or warranties regarding the accuracy, completeness, or clinical applicability of any content. Never rely solely on SmartPeds content for clinical decision-making.

8. Disclaimers and Limitation of Liability

The Service is provided “as is” and “as available” without warranty of any kind. SmartPeds does not warrant that:

• The Service will be uninterrupted or error-free
• Content is accurate, complete, or current
• Use of the platform will result in passing any licensing exam

To the maximum extent permitted by law, SmartPeds shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of data, loss of revenue, or failure to pass an examination, arising out of or related to your use of the Service.

9. Account Termination

We reserve the right to suspend or terminate your account at any time if you violate these Terms. You may also delete your account at any time by contacting us. Upon termination, your right to access the Service ceases immediately.

10. Changes to the Terms

We may revise these Terms at any time. We will notify you of material changes by email or by posting a notice on the site. Continued use of the Service after changes take effect constitutes your acceptance of the revised Terms.

11. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of Israel, without regard to conflict of law principles. Any disputes shall be resolved in the competent courts of Israel.
